Agreement Recommendations

Legal Tenancy Agreement

The rental legislation is complex, and our legal expects will advice you with the latest updates. The agreement, which is widely used in the industry is an Assured Shorthold Tenancy regulated by the 1988 Housing Act. We will prepare this agreement. There is other types of agreements which are suitable for different circumstances, we will make sure you have the right agreement in place.

Deposits

To ensure against any accidental damage by the tenant, a security bond is retained. This deposit is only refunded at the end of the tenancy period subject to a full and satisfactory inspection of your property.

Keys

We require two sets of keys for the property. If only one set is provided, we will obtain an additional set and charge accordingly.

Repairs & Maintenance

As, a landlord, your responsibilities during a tenancy can be daunting. It is crucial that your property is well looked after, and its continued maintenance is important to the success of the tenancy.

Managing a property and dealing with various issues that arise during a tenancy is a demanding and time consuming business. Our management service will ensure that all aspects are dealt with efficiently and cost effectively.

We will undertake to attend day-to-day, which may be necessary. These repairs and maintenance will not be carried out without obtaining the authority from the owner. However, at the time of signing our Management Agreement, a repair limit is agreed. In the cases of EMERGENCY REPAIRS, which rise above the repair limit, we will carry out the necessary work and inform the owner as soon as possible.

Rent Collection & Monthly Statement

Collection of rent from tenants by standing order will be forwarded to your nominated accounts. A fully computerised rent collection system is in operation, which allows us to get up-to-date individual account details.

Property Visits

During the tenancy, visits to the property will be carried out to check the general condition of the property.

Building Insurance

You are responsible for having valid insurance cover on your property. You must inform your insurance company of your intention to let. Your Buildings and Contents Insurance should have the provision for Letting and Public Liability.

Safety Regulations

There are legal requirements governing the safety requirements for the letting of residential property. Non compliance with these regulations carries substantial fines and possible imprisonment and is decided by the courts. At all times a landlord must be aware that he has a Duty of Care t his tenants. Our offices will address the issue of compliance with the appropriate legislation when instructed.

Gas Safety (Installation and Use) Regulations 1994

A Gas Safety Certificate is required under the Gas Safety Regulations 1994. These regulations came into effect on the 31st October 1994 to ensure that gas appliances are properly installed and maintained in a safe condition so to avoid the risks of carbon monoxide poisoning. It is the responsibility of landlords of domestic properties that ALL Gas Appliances and Gas Installation Pipework owned by them are checked for safety at least once a year by a member of the council for Registered Gas Installers (CORGI). A current Safety Certificate must be available for any tenant prior to them taking occupation of a property. Failure to comply with these regulations will lead to prosecution with penalties of imprisonment or fines up to £5,000.

Electrical Equipment (Safety) Regulations 1994

These regulations state that any landlord supplying electrical equipment must ensure that it is safe and will not cause danger and meet their regulations.

The electrical equipment (safety regulation 1994) covers all mains household goods including washing machines; kettle leads plugs and sockets etc. the plug and socket safety regulation 1994 covers all plugs and sockets and insulations. Along with the consumer act1987 section 39 all impose an obligation on the supplier (LANDLORD) to ensure that all this equipment, earthing and cabling is safe and must be able to prove so. Also, under the consumer protection act 1987 section 39 you must ensure that there is no risk of injury or death to humans or animals or risk or damage to the property.

It can be deemed to be adequate defence to show that you have taken all necessary steps to ensure that your properties compliance.

Although the law says the electrics have to be safe, how do you know they are safe if you do not have them checked out? Due to the increase in the number of electrocutions and electrical fires and alarmingly deaths that have occurred due to electric shocks, it is believed that even with brand new properties it is impossible to ensure that the portable appliances meet the requirements unless they have been tested.
